Must I spend influence to beat a black die I can't counter?
Phase 3 of the rulebook states the 2 VP penalty for an uncountered black die.

No. Influence is optional. If you fail to counter a black die, it is discarded without costing you dice, but you lose 2 VP (nothing if you have none).
