Legality is checked after you have placed every part of the Upgrade, not after each one, and every blueprint must end legal even with no ships built. Interceptors, Cruisers and Dreadnoughts need at least one Drive and enough energy for all their parts; Starbases cannot have a drive. A ship may be driveless only mid-upgrade.
